How hybrid fund finance fits into the mix

Day two of the Private Funds Compliance Forum kicks off with a much-anticipated SEC session, while we are kicking off Friday with some insight into fund finance and impending ESG laws.

It’s day two of the Private Fund Compliance Forum in San Francisco, and it kicks off in style with senior SEC OCIE execs Kristin Synder and Andrew Weilbacher being quizzed by BDO assurance partner Dale Thompson.

For those firms doing business in Europe: read this insight from lawyers at Debevoise on the impending arrival of EU rules on ESG. One law that leaps out is the Disclosure Regulation, which will require managers to disclose how they have considered sustainability issues that materially affect the value of an investment.

“Perhaps more significantly,” say the lawyers, “firms will also have to say whether they have taken account of societal impacts more broadly – even those impacts that may not affect an investment’s value.”
