Among the biggest regulatory and litigation risks facing private funds this year are cyber risk, an increasingly active SEC Office of Compliance Inspections and Examinations and overheated unicorn valuations, according to a team of lawyers at Proskauer.

Josh Newville and Tim Mungovan, partners in Proskauer’s litigation department, stress that just because the SEC is focusing on the protection of individual retail investors, fund managers shouldn’t expect scrutiny to ease off.

In this 12-minute podcast, the partners also discuss disclosure of fees, expenses and conflicts of interest – which is still the number one issue that comes up during SEC exams – as well as potential issues managers should be aware of when handling alternative data sets.
